What is Mail Fraud?

Mail fraud is the use of the U.S. Postal Service to further any scheme to defraud or obtain property or money through false statements. The fraud does not have to start with the mail; it may have originated through the use of a telephone or the internet. As soon as anything is sent through the mail as part of the fraud, it becomes mail fraud. Investigations of mail fraud are usually initiated based on complaints from the public, and conducted by Postal Inspectors.

Federal Mail Fraud Statute

The federal statute 18 U.S.C. ยง 1341 establishes mail fraud as using the postal service to deliver any piece of mail that furthers or facilitates obtaining money or property through false promises. This includes devising or intending to devise any scheme to defraud which uses the mail. It is also a violation to sell or distribute counterfeit currency or any other counterfeit monetary instruments through the mail.

If convicted of the charge of mail fraud the penalty can be up to a maximum of 20 years in prison, plus fines. The penalties are further enhanced if the mail fraud involves any connection with a declared major disaster or emergency, and also if the fraud affects a financial institution. In those cases the maximum prison sentence is raised to 30 years, in addition to the fines which can be escalated up to $1,000,000.
