War Crimes Law

War crimes are violations of the international laws of war. The laws of war are determined by treaties to which the United States is a party. Chief among these are the laws of The Hague Convention, which date to 1907, and the Geneva Convention, which followed WW II. In the United States, war crimes are dealt with in 18 U.S.C Chapter 118 ยง 2441. This statute encompasses any war crime committed by a member of the armed services or any national of the United States. Anyone found guilty of a war crime can be punished with sentences including life in prison or the death penalty.

What is a War Crime?

The following acts can be considered war crimes:

  • Torture/Cruel or inhuman treatment - inflicting severe physical or mental pain or suffering upon a person who is in custody or physical control
  • Performing biological experiments - subjecting someone in custody to biological experiments without a legitimate medical or dental purpose
  • Murder - intentionally killing someone who is taking no active part in the hostilities
  • Mutilation or maiming - intentionally disfiguring, permanently disabling, or mutilating someone who in not taking active part in the hostilities
  • Rape - forcible penetration with a body part or foreign object
  • Sexual assault or abuse - forcibly engaging in sexual contact, or causing one or more persons to engage in sexual contact
  • Taking hostages - seizing and threatening to kill, injure, or continue to detain a person or persons in order to exert influence over any nation or group, using conditions for the safe release of the detained
